1. The app and its publisher

Gravion is an interactive particle simulation for iPhone and iPad, published by:

2. Acceptance of these terms

By downloading, installing or using Gravion, you accept these Terms of Use in full. If you do not accept them, please do not use the app.

These terms form a legally binding agreement between you ("you", "the user") and the publisher of Gravion ("we", "us"). They are completed by our Privacy Policy.

3. What Gravion is

Gravion simulates a field of light made of hundreds of thousands of particles that react to your finger or to an Apple Pencil. It offers signature atmospheres, a Studio to combine powers and materials, a Standby particle clock, guided breathing sessions, a Zen mode, and the ability to save images and videos.

Gravion is a relaxation and entertainment product. It is not a medical device, not a therapy and not a substitute for professional care.

The app works entirely offline. It requires no account and no registration.

4. Licence

We grant you a personal, non-exclusive, non-transferable and revocable licence to use Gravion on the Apple devices you own or control, in accordance with the App Store Terms of Service and with Apple's Licensed Application End User Licence Agreement.

You may not copy, sell, rent, sublicense or redistribute the app; reverse-engineer, decompile or disassemble it except to the extent that applicable law expressly permits it; extract its assets, shaders, sounds or atmospheres for reuse; or remove or alter any proprietary notice.

5. Free version and Gravion Unlimited

Gravion is free to download. The free version gives you the Neon field for life, three 20-second trials of the signature atmospheres, 4K stills, Zen mode, the settings, and video recording of up to 15 seconds.

Gravion Unlimited is a one-time, non-consumable in-app purchase. It unlocks all 21 signature atmospheres, the Studio, Standby, Breathing, and video recording with no time limit, on both iPhone and iPad. It is not a subscription and it never renews.

A higher-priced Supporter tier is also offered. It unlocks exactly the same features; the difference is only that it supports an independent developer.

Prices are shown in the App Store in your local currency and may change over time. A purchase already made is never affected by a later price change.

The purchase is attached to your Apple Account and is eligible for Family Sharing. "Restore Purchases" is available on the purchase screen and in the app's settings.

6. Payments and refunds

All purchases are processed by Apple, not by us. We never receive your payment details.

Refund requests must therefore be made to Apple, through reportaproblem.apple.com or through your Apple Account's purchase history. We have no technical ability to issue a refund ourselves, though we are happy to help you with the process.

Consumers in the European Union have a statutory right of withdrawal. By downloading the unlocked content immediately after purchase, you request immediate performance of the contract; where applicable law allows, this may end the withdrawal period once the content has been delivered. Nothing in these terms removes any mandatory consumer protection you are entitled to under the law of your country of residence.

7. What you create

The images and videos you capture in Gravion are yours. You may use them freely, including commercially, on any platform, with no watermark, no attribution requirement and no fee.

Credit is appreciated but never required. This permission covers the captures you make; it does not grant any right over the app itself, its name, its logo or its code.

8. Acceptable use

You agree not to use Gravion in a way that breaks the law, and not to attempt to bypass the in-app purchase system, tamper with the app, or use it in any environment where a distraction could be dangerous.

Gravion requires your visual attention and, on iPad, an Apple Pencil. Do not use it while driving, cycling, operating machinery or walking in traffic.

9. Health and safety

9.1 Photosensitivity. Gravion produces bright, rapidly changing and flashing light, including sudden explosions of high-contrast particles. A very small percentage of people may experience seizures, blackouts, altered vision, disorientation or involuntary movements when exposed to flashing lights or patterns, even with no personal or family history of epilepsy. If you or anyone in your family has a history of epilepsy or seizures, consult a doctor before using the app. Stop using Gravion immediately and consult a doctor if you experience dizziness, nausea, altered vision, eye or muscle twitching, disorientation or convulsions. Use the app in a well-lit room, keep a reasonable distance from the screen, and take a break every 30 minutes. The app's Studio lets you lower the bloom, the burst and the shockwave if you prefer a calmer field.

9.2 Sound. Gravion can produce loud generative sound. Prolonged listening at high volume can damage your hearing. Set the volume at a comfortable level before using headphones.

9.3 Breathing sessions. The guided breathing sessions (box breathing, 4-7-8, cardiac coherence) are a relaxation feature, not medical advice, not a diagnosis and not a treatment. Breathing exercises are not suitable for everyone. Do not practise them while driving or in water, stop if you feel lightheaded, and ask a healthcare professional first if you are pregnant or have a respiratory, cardiac, anxiety or blood-pressure condition.

9.4 Children. Gravion is rated 4+. Because of the flashing light described above, we recommend adult supervision for young children and shorter sessions.

10. Intellectual property

Gravion, its name, its logo, its interface, its simulation engine, its shaders, its atmospheres, its sound design and all of its content are protected by intellectual property law and remain the exclusive property of the publisher.

Nothing in these terms transfers any of those rights to you, other than the licence described in section 4 and the rights over your own captures described in section 7.

11. Availability and changes to the app

We may update Gravion, add features, change them or remove them, and we may stop distributing the app. We will not, however, remove a feature that Gravion Unlimited was sold on without offering it in some equivalent form, unless a technical or legal constraint outside our control forces us to.

Gravion depends on Apple's operating systems and hardware. A future version of iOS or iPadOS may change or break behaviours we do not control.

The app requires iOS or iPadOS 18 or later. Performance, particle counts and some effects depend on your device.

12. Disclaimer of warranties

To the fullest extent permitted by law, Gravion is provided "as is" and "as available", without any warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement.

We do not warrant that the app will be uninterrupted, error-free or compatible with every device or configuration.

Some jurisdictions do not allow the exclusion of implied warranties, so this exclusion may not apply to you. Consumers keep the legal guarantee of conformity provided by their national law.

13. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to Gravion is limited to the amount you actually paid for the app in the twelve months preceding the event giving rise to the claim.

We are not liable for indirect or consequential damages, loss of data, loss of captures, or loss of profit.

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded.

14. Termination

You may stop using Gravion at any time by deleting the app. Since there is no subscription, there is nothing to cancel.

Deleting the app does not cancel your purchase: reinstalling and using "Restore Purchases" with the same Apple Account brings Gravion Unlimited back.

We may terminate this licence if you materially breach these terms, in particular section 8.

15. Apple

These terms are concluded between you and the publisher of Gravion, not with Apple. Apple is not responsible for the app or its content.

Apple has no obligation to provide any maintenance or support for Gravion. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app.

Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, will have the right to enforce them against you.

16. Governing law and disputes

16.1 Governing law. These terms are governed by French law.

16.2 European Union users. Under European consumer law, the more favourable provisions of the law of your EU country of residence may apply. Nothing in these terms deprives European consumers of the legal protections they are entitled to.

16.3 Users outside the EU, including the United States. For disputes involving users residing outside the European Union, the competent courts are those of Grenoble, France, unless a mandatory rule of the user's country of residence provides otherwise.

16.4 Resolving disputes. We prefer to settle things amicably. Please write to contact@healdaily.app before starting any legal action. European consumers may also use the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr

17. Miscellaneous

17.1 Entire agreement. These terms, together with the Privacy Policy, constitute the entire agreement between you and the publisher regarding Gravion.

17.2 Severability. If any provision is held invalid or unenforceable, the remaining provisions stay in force.

17.3 No waiver. Failing to enforce a right under these terms is not a waiver of that right.

17.4 Changes. We may update these terms. The date at the top of this page changes when we do, and continuing to use the app after an update means you accept the new version.
